Buying from Here’s a Gift.

These terms explain how orders for our personalised physical products work, including payment, delivery, cancellations and what happens if something goes wrong.

The important bitsHere’s A Gift is the trading name of Kayleigh Waterman, a sole trader. Delivery is currently to UK addresses only. Standard delivery is included, with an estimated total delivery time of up to 5 working days. Speedy delivery is £6.95, with an estimated total delivery time of up to 3 working days. We do not currently add VAT.

1. Who you are buying from

These terms apply when you buy physical products from us as a consumer, mainly for personal use. Please contact us separately about trade or resale orders. Contracts are made in English. Nothing in these terms removes your statutory consumer rights.

2. Placing an order

Choose your product, size and options, add the personalisation and check the preview, spelling, order summary and delivery address before paying. You can correct your details before submitting the order.

Your order is a request to buy. We accept it when payment is authorised and we confirm the order or begin processing it. The payment receipt confirms that payment has been taken, but does not remove any statutory rights. The products, personalisation, price and delivery choice recorded in your checkout and order communications form the basis of the order.

Before accepting an order, we may decline it because a product is unavailable, payment has not been authorised, we reasonably suspect fraud, the content is unlawful or infringes someone else’s rights, or there is an obvious pricing or product information error. We will explain the issue where appropriate and promptly refund any payment taken for an order we do not accept.

We will not increase an agreed price or make a material change to an accepted order without your agreement. Keep your order details and the version of these terms supplied when you order.

3. Personalisation and previews

Please check names, spelling, punctuation, dates, wording, photographs, layout, size, frame colour and delivery address carefully. We normally print the information you submit rather than correcting or rewriting it. We may contact you about something that appears wrong, but this is not a proofreading service.

Where a mistake comes solely from information you entered and we accurately reproduce it, that mistake does not by itself make the product faulty. This does not excuse an error caused by our website, a misleading preview, a production fault or a failure to supply the agreed product.

Preview images help you check your design. Small differences in screen colour, material texture and print appearance can occur. This is not permission for substantial differences, missing content, poor quality printing or changes to an agreed layout.

Please use photographs and artwork suitable for the print size you choose. We will take reasonable care when producing your order and remain responsible for meeting the agreed specification and your statutory rights.

4. What is included

The product description and the options selected at checkout describe what you are buying. Sizes are the stated product or print dimensions, not the apparent size in a room photograph.

Our framed prints are supplied without a separate card mount unless a product description expressly says otherwise. Artwork fills the print area, subject to any design border shown and the small edge covered by the frame. Room accessories shown for styling are not included.

A cushion cover only option does not include an inner cushion. An inner is included only where the selected product option says so. Check the listed materials, dimensions and care instructions for the product you choose.

5. Prices and payment

Prices are shown in pounds sterling. The product price includes standard delivery to the delivery areas shown before checkout. We do not currently add VAT to your order.

Where offered, speedy delivery costs an additional £6.95 per order. Any delivery restrictions and the complete amount payable are shown before you pay. We will not add compulsory charges after checkout.

Payment is taken using Stripe and the payment methods displayed at checkout. Full payment is required before production. Refunds are returned to the original payment method unless you expressly agree otherwise, without a refund processing fee.

6. Production and delivery

We currently deliver to UK addresses only.

Standard delivery is included. The estimated total delivery time is up to 5 working days from order acceptance. Where offered, speedy delivery costs £6.95 per order and has an estimated total delivery time of up to 3 working days from order acceptance. These periods include production and delivery.

Working days are Monday to Friday, excluding UK bank holidays relevant to the service. Any order cut off or longer period for a particular product will be made clear before you order. Multiple products may arrive in separate parcels, without an additional charge unless agreed before purchase.

We will deliver within the period agreed with you. Where no period has been agreed, we will deliver without undue delay and within 30 days. We will let you know about a delay and take reasonable steps to resolve it. An estimate does not remove your legal rights.

If we miss an agreed delivery deadline, you can normally give us an appropriate further period to deliver and cancel if we still do not deliver. You can cancel without that further period where we refuse delivery or delivery by the agreed deadline was essential, whether clear from the circumstances or made clear before the contract.

When you lawfully end an order for late or failed delivery, we will refund the sums due without undue delay. Any refund of the speedy delivery charge will reflect the service supplied and your legal entitlement.

We remain responsible for the goods until they reach you or a person you nominate to take physical possession. We will deal with our delivery partner about loss or damage. You do not have to resolve our courier claim yourself.

Please tell us promptly about an incorrect address. Where a delivery problem is caused by incorrect details you supplied, we may ask you to cover a reasonable additional redelivery cost, agreed with you first. We will not charge this where the mistake is ours or our delivery partner’s.

7. Changes and cancellations

Personalised goods made to your specification do not normally have the statutory 14 day change of mind cancellation right. This applies because of the nature of the goods, not simply because production has started.

Contact us immediately if you need to change or cancel a personalised order. We will check whether we can stop or amend it, but we cannot promise a cancellation window because production may begin quickly. A change or cancellation is agreed only when we confirm it. We will explain any proposed charge before you agree. There is no automatic cancellation fee.

An item is not excluded from cancellation simply because it is printed after ordering or selected from standard sizes or colours. Where an item is not genuinely personalised or otherwise exempt, the ordinary cancellation rights in our Returns and Refunds Policy apply.

8. Faulty, damaged or incorrect goods

Your products must be of satisfactory quality, fit for their usual purpose and any particular purpose agreed with us, and as described. These rights apply to personalised products as well as standard products.

Our Returns and Refunds Policy explains how to report a problem, the applicable remedies and return arrangements. You deal with Here’s A Gift, not our printer. We will cover reasonable return costs where goods are faulty, damaged on arrival or not what you ordered.

We may ask for photographs to help us understand a problem, but an inability to provide them does not automatically remove your rights. There is no compulsory 24 or 48 hour reporting deadline and no requirement to keep original packaging to preserve a statutory claim.

9. Your photographs and other content

You keep the rights you already hold in material you provide. You give us and the suppliers involved in your order permission to use, format, reproduce and print that material only as needed to fulfil the order, provide support and deal with a related claim.

You must have the rights and permissions needed to use the material, including photographs of other people and information about children. Do not submit unlawful content or content that infringes someone else’s rights. We may refuse such content and will explain the outcome for your order and payment.

This permission does not allow us to use your photographs or personalised products in advertising. We would ask separately before doing that. Our original designs and website material remain protected by the rights of their owners. Buying a physical product does not grant a licence to reproduce our designs commercially.

10. Responsibility and events outside our control

We are responsible for reasonably foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. Loss is foreseeable if it is an obvious result or was reasonably contemplated when the contract was made.

These products are supplied under these terms for private use, not commercial resale. Nothing excludes or limits liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud, or your statutory rights concerning the goods.

If events outside our reasonable control affect an order, we will explain what has happened and take reasonable steps to reduce the effect. This does not remove your rights to cancel, receive a refund or claim another remedy where the law provides one.

Include your order details and the outcome you are seeking. We will consider the complaint promptly, keep you updated and explain our decision. You do not have to use a particular form.

When giving our final response, we will explain any alternative dispute resolution or other arrangement available for your complaint and how to access it. You retain any right to seek help or bring a court claim.

12. Privacy, changes and governing law

Our Privacy Policy explains how we use personal information. Our Cookie Policy explains website storage and tracking. Agreeing to these terms is not consent to optional marketing or tracking.

The version of these terms supplied when you order applies to that order. Later changes do not retrospectively change an existing contract. If a provision is unenforceable, the remaining terms continue where they can lawfully do so.

These terms are governed by the law of England and Wales. This does not deprive you of mandatory consumer protections that apply where you live. A consumer living in Scotland or Northern Ireland may bring proceedings in their local courts as well as any other court with jurisdiction.
